The contract between you and LOKA when you buy a personalised travel plan. Written in plain English so you actually know what you're agreeing to.

01Parties & acceptance

These Terms form a contract between you ("you", "the customer") and Amphi Labs BV (in formation) — a private limited company being constituted under the law of the Netherlands ("BV in oprichting" / BV i.o.) — trading as LOKA — Fair Travel ("LOKA", "we", "us"). Until incorporation (expected 1 July 2026), the contract is concluded with the company-in-formation, acting through its founder. On incorporation, all rights and obligations under this contract transfer to Amphi Labs BV by operation of Dutch corporate law (Article 2:203 Dutch Civil Code); we will notify you by email when this happens.

By completing checkout you confirm that (a) you are at least 18 years old, (b) you have legal capacity to enter into a contract, and (c) you have read and accepted these Terms, our Privacy Policy, our Cookie Policy and our Acceptable Use Policy.

02What you get

LOKA produces a personalised travel plan for a trip to Mexico, based on the answers you give in the LOKA quiz. The plan is delivered as a digital document (typically HTML/PDF, viewable in any modern browser) sent to the email address you provide. A typical plan contains:

LOKA is a planning service. We are not a tour operator, travel agency or transport carrier. We do not sell flights, accommodation, transfers, tours or insurance in our own name. Bookings with the suggested partners are contracts between you and that partner.

03Account & accuracy

You don't need a permanent account. Each plan is created from the quiz answers you provide. You are responsible for giving us accurate information — if you say the wrong dates, list dietary restrictions you don't actually have, or hide the fact that you're travelling with a child, the plan we produce may not fit your trip.

04Price & payment

The price of a plan is shown before you confirm your purchase, in your local currency where possible, including any applicable taxes. The total displayed on the checkout summary is the final amount you will be charged — no hidden fees.

Payments are processed by Stripe Payments Europe Ltd. We never see your full card details. By paying, you also accept Stripe's terms with respect to the payment transaction.

If a transaction is declined, fails, or is reversed by your bank, we will not deliver the plan until the charge is successfully cleared.

05Delivery

We aim to deliver your plan to the email you provided within 24 hours of receiving payment and a complete set of quiz answers. Most plans are delivered faster. If we expect a delay (for example, due to a particularly complex multi-region request), we will tell you by email.

Check your spam folder if you haven't received the plan after 24 hours. If it's still missing, write to amo@amphilabs.com and we will re-send.

0614-day right of withdrawal — and the digital-content waiver

Under EU consumer law (Directive 2011/83/EU), consumers in the EU normally have 14 days after concluding a distance contract to withdraw, without giving a reason.

Important — digital content exception. Your LOKA plan is custom digital content. The law allows you to lose the right of withdrawal if (i) we begin delivery with your prior express consent, and (ii) you expressly acknowledge that you lose the right of withdrawal once delivery is complete (Article 16(m) of Directive 2011/83/EU). At checkout you will be asked to tick a clearly labelled box confirming both of these. If you tick that box and we deliver your plan, no refund is due under the withdrawal right.

If you do not tick that box at checkout, you keep the full 14-day withdrawal right. To exercise it, send us an unambiguous statement (email is fine) within 14 days of placing your order. We will refund all payments within 14 days of receiving your notice, using the same payment method, free of charge.

07Refunds & complaints

Beyond the statutory withdrawal right, we will refund you in full if:

Complaints: write to amo@amphilabs.com. We acknowledge within 48 hours and aim to resolve within 14 days. If we cannot reach an agreement, you may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

08Intellectual property

The plan we deliver is licensed to you for personal travel use. You can print it, share it with your travel companions, and forward it to a friend who's curious. You cannot resell it, publish it on a public website, repackage it as your own product, or use it to train a competing recommendation system.

The LOKA brand, the website, the quiz logic, the recommendation database and the underlying methodology remain our property.

09Third-party partners

The hotels, guides, drivers, restaurants and experiences in your plan are independent third parties. When you book or buy from them, you are entering a contract with them, not with LOKA. We pick partners carefully and re-verify them periodically, but we cannot be held responsible for:

For travel itself we strongly recommend you buy travel insurance with medical, cancellation and luggage cover.

10Liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Dutch or EU law.

Subject to that, our total liability for any claim arising out of or in connection with a plan you bought is capped at the price you paid for that plan. We are not liable for indirect or consequential losses (for example, the cost of a missed flight, lost holiday enjoyment, or unrealised business opportunities).

11Suspension & termination

We may refuse to deliver, suspend, or cancel a plan if we believe you are using LOKA in violation of these Terms or the Acceptable Use Policy — for example, providing false data, attempting to resell plans commercially, or using the service for fraudulent transactions. In such cases we will refund any portion of the price that does not relate to work already performed.

12Changes to these terms

We may update these Terms. The version that applies to your purchase is the one in force when you completed checkout. For ongoing relationships (for example, future purchases), we will tell you about material changes by email, and you will be deemed to accept them by placing another order.

13Governing law & courts

These Terms are governed by the law of the Netherlands (the seat of Amphi Labs BV, in formation). If you are a consumer, you also benefit from the mandatory consumer-protection rules of the EU country where you habitually reside, and you can bring proceedings in the courts of that country. Otherwise, disputes are subject to the competent courts of the Netherlands.
